Terms for buying and using a FairBillCheck report

These terms cover your use of fairbillcheck.com and your purchase of a FairBillCheck report. By using the site or buying a report you agree to them.
1. What you are buying
A one-time report for $29, delivered as a PDF, that compares the charges you enter from a medical bill with Medicare's published payment amounts for the codes, setting and locality you choose, and includes a letter you can send to the billing office. When you tell us you paid without insurance and had a Good Faith Estimate, it also includes a checklist for the federal patient-provider dispute process.
2. A benchmark, not advice
The report is information, not medical, legal, financial or billing advice. The Medicare amount is a public benchmark: it is not what you owe, not a price any provider has agreed to, and not a legal limit on what a provider may charge. We do not promise that any provider will reduce a bill, and we never contact a provider, insurer or collector on your behalf. The letter is a document you review, edit and send yourself. The dispute checklist describes a federal process; whether you qualify depends on facts we cannot check. For advice about your situation, consult a qualified professional, such as a patient advocate or an attorney.
3. Accuracy depends on what you enter
The report is only as accurate as the codes, units, amounts, ZIP code, dates and bill type you enter. Medicare amounts come from CMS files named in each report, which CMS revises on its own schedule.
4. No warranty
The site and the report are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement.
5. Limitation of liability
To the maximum extent the law allows, FairBillCheck and its operators are not liable for indirect, incidental, special, consequential or punitive damages, or for any loss arising from your use of the site or the report, and our total liability for any claim about a report is limited to the $29 you paid for it.
6. Refunds
If you paid and did not receive a report, or the report could not be produced from the details you entered, email [email protected] and we will deliver it or refund you. If a Medicare figure in your report does not match the CMS file it cites, tell us: we will check it and, where the error is ours, correct the report or refund you.
7. Acceptable use
Do not resell or republish reports, scrape or bulk-download the site, try to disrupt or gain unauthorized access to it, or use it for anything unlawful. Your report is licensed to you for your own use, including sending the letter to your provider.
8. Ownership
The site, its text, design and report format belong to FairBillCheck. Medicare data belongs to its public sources. CPT is a registered trademark of the American Medical Association, and CPT descriptions are not reproduced.
9. Third-party services
Payments are processed by Stripe under Stripe's terms. Visits are counted with Fathom Analytics. See the privacy policy.
10. Governing law
These terms are governed by the laws of the United States and, where applicable, the state in which FairBillCheck's operator is established, without regard to conflict-of-laws rules.
11. Changes
If these terms change, we will update the effective date above. Using the site after that means you accept the revised terms.
